Rules of advertising service

Article 1. Rules for accepting product feeds

(*) A product feed is a file of a certain format containing all currently available product offers of a particular online store. Information about goods and services must be provided in the state language, according to Ukrainian legislation.

1.1. The basis for placing product offers of an online store on hotline.ua is the Advertising Service Agreement executed in accordance with current Ukrainian legislation, as well as prepayment.

1.2. A product feed of an online store must be prepared in one of the formats described in the Requirements for Product Feeds section and shall comply with the Requirements for the Content of Product Feeds.

1.3. Only such product offers of an online store that strictly comply with the Hotline Rubric shall be placed on hotline.ua.

1.4. A product feed provided by the Customer shall be published for no more than 7 days. If the Customer has not uploaded an updated product feed after the expiration of the specified time, the publication of the previous one shall be terminated.

1.5. It is not allowed to use the following in product offers:
  • a) telephone numbers, e-mail addresses, postal addresses, numbers or identifiers of Internet messengers, including the placement of this information on product images;
  • b) words in capital letters; the exception is abbreviations and trademarks with generally accepted capitalization;
  • c) html tags and special characters;
  • d) listing and various variants of spelling of a product offer, as well as the following words: "discount", "sale", "cheap", "gift", "free", "promotion", "special price", "novelty", "new", "analog", "order", "prize"
  • e) inscriptions (logos, texts, links, watermarks, etc.) are not permitted on photos of goods, links to which are placed in a product feed of an online store.

1.6. Product offers must contain reliable information and correspond to the actual current offer of the store. The specified price of the goods shall be the retail price in UAH. Product availability, the price, delivery time and other terms of a product offer on hotline.ua and on the Customer's website must match.

1.7. A product offer of an online store posted on hotline.ua must correspond to the content of the page of the site to which the associated link leads. The web address of an online store's website must correspond to the website specified in the Agreement and the Store Questionnaire.

1.8. It is not permitted to "duplicate" product offers, when the same (identical) product offers are indicated in the feed more than once.

1.9. It is not permitted to indicate advertising information in the "product description" field: - the information should be of a descriptive nature only, for example, technical characteristics and/or description of the appearance.

1.10. The Contractor may independently edit the name of the goods without notifying the Customer in accordance with the form of submission of information on hotline.ua.

1.11. The inclusion of goods in the catalog remains at the discretion of the Contractor and is not mandatory.
To place unique offers in the catalog, it is necessary to fill in the technical characteristics of these goods in the Customer's account (subject to the preliminary creation of cards), or transfer data through the feed using the "param name" that meets the Requirements for the content of product feeds.

1.12. The Customer shall place information about the online store and its logo independently in its account on hotline.ua. The use of someone else's logo (in whole or in part) as the logo of the online store on the pages of hotline.ua is allowed only if written permission is provided to the Customer from the owner of such logo or from an authorized person.

1.13. The Customer grants the Contractor a valid worldwide, irrevocable, sublicensable right to use, publish, display, copy and duplicate the information, text messages, graphic images and photographs provided by them. The Customer shall retain all ownership rights to the posted information. These rights are granted by the Customer to the Contractor for the term of the Agreement for the performance of the Contractor's duties (a set of advertising services). In addition to the above, the Customer gives the right to access the information posted by them to all users of hotline.ua

1.14. The Contractor reserves the right to refuse, at their sole discretion, to place product feeds provided by the Customer and/or Customers containing information about products offered in several online stores (sites) and suggesting the existence of interchangeability, affiliation, or other relationship between them.

1.15. The Contractor reserves the right not to place in the catalog models of goods that are no longer in production.

1.16. The Customer is prohibited from including in their product feed and placing on hotline.ua used goods.
Refurbished and discounted goods that have never been in use can be placed only if the corresponding parameter is specified in the product feed.

1.17. The Customer is prohibited from including in its product feed and placing on hotline.ua counterfeits (replicas) of goods. In case of reasonable doubts about the originality of the goods or the need to confirm their originality, the Contractor has the right to request relevant documents from the Customer.

If the placement of a counterfeit has led to claims against the Contractor by the trademark owner, the Customer shall bear all responsibility for the placement to the trademark owner.

1.18. The customer can place on hotline.ua products that are in stock or on order.
For products with the status "on order", it is mandatory to indicate the parameter of shipment from the warehouse in the corresponding field, according to the Requirements for product feeds.

1.19. If a product feed does not comply with these Rules, the Contractor reserves the right to refuse to publish it.


Article 2. Rules for the Placement of Special Offers

2.1. The Customer independently places special offers in the account of their online store on hotline.ua.

2.2. Methods of adding special offers::
  • automatic via an XML file (regular automatic import of special offers);
  • manual via an XML file (one-time upload of special offers);
  • fully manual, using the functionality for adding special offers available in the account of the Customer’s online store.

2.3. Rules for adding special offers:

2.3.1. A special offer must contain information about the material benefit for the buyer: a discount on a promotional product, a gift, a refund of part of the cost, etc.;

2.3.2. It is not permitted to place a special offer that contains a call for a targeted action (calls to buy, call, contact, etc.).

2.3.3. The following may not be used in the gift description:

  • a) phone numbers, e-mail addresses, postal addresses, numbers or identifiers of Internet messengers;
  • b) words in capital letters; the exception is abbreviations and trademarks with generally accepted capitalization;
  • c) html tags and special characters.

2.3.4. A link to a special offer should lead to a page with information about the terms of the special offer on the store's website, or to the product page, which contains information about the terms of the special offer.

2.3.5. Only one special offer can be added to one product.

2.3.6. Special offers timed to Black Friday can be posted only with the inscription "Discount on the product", the amount of the discount must exceed 10%. If this condition is not met, the Black Friday inscription will be disabled for the special offers in which the violation was detected.

2.4. The Contractor reserves the right to remove from hotline.ua the special offers in which violations of the Rules for the Placement of Special Offers are detected.


Article 3. Liability for violation of the Rules of Advertising Service

3.1. If the Customer violates the requirements of clauses 1.5., 1.6., 1.7., 1.8., 1.9., 1.10, 1.16, 1.17, 1.18 of these Rules, the Contractor has the right to:

3.1.1. In case of a violation by the Customer of the requirements of the above clauses of the Rules for the first time, send a notice of the violation and a warning of liability for the repetition of such violations to the Customer's e-mail specified in the online store account;

3.1.2. In case of repeated violations by the Customer of the requirements of the above clauses of the Rules, suspend the Customer's service for a period of up to 60 (sixty) calendar days. The Customer will be sent a notice of suspension, as well as the conditions for resuming the placement of the Customer's product offers of the Customer's online store in terms of compliance with the requirements of the Rules, to the e-mail address specified in the online store account;

3.1.3. In case of a violation of the above Rules by the Customer more than twice, or in case of failure by the Customer to fulfill the conditions after the resumption of placement in accordance with clause 3.1.2., the Contractor shall have the right to terminate this Agreement unilaterally.

3.2. The Contractor also has the right to terminate this Agreement unilaterally in case of systematic (more than 2 ) violations by the Customer of the requirements of clauses 1.6, 1.7, 1.16, 1.17, 1.18 of these Rules, as well as in the following cases:
  • creation by the Customer of fictitious reviews on their online store;
  • substantiated complaints from users of hotline.ua (more than 2) regarding the provision of false information by the Customer;
  • substantiated complaints from users of hotline.ua (more than 2) about violations of the Consumer Protection Law by the Customer. And if the buyer has suffered direct material losses - in the case of one confirmed complaint;
  • if the Customer violates the rules for conducting activities among their customers more than twice in order to increase the number of reviews on hotline.ua;
  • if the Customer's rating on hotline.ua for the last three months was 3 points or lower.

3.3. The Contractor has the right to terminate this Agreement unilaterally if the Customer, in the process of communication, within the framework of business relations with the Contractor and other participants of hotline.ua, in oral or written communication, deliberately uses:

  • insults;
  • obscene statements;
  • swearing

in relation to the users of hotline.ua, other online stores and their representatives, employees of HOTLINE LLC.

3.4. Both the Contractor and the Customer have the right to initiate termination of the Agreement unilaterally if the cost of the services provided by the Contractor is less than UAH 100 per month.

All materials about the Customer (reviews, comments, etc.) posted by users of the site during the term of the Agreement shall not be deleted after the termination of the Agreement and shall remain on hotline.ua.

The validity of complaints shall be determined solely by the Contractor.
